How can I make my cousin and his wife my legal guardians?

My mom passed away last year and I do not get along with my father I would also like to change my last name to my mother's last name since I am going to be starting a new high school in a new city I am under age and if i did change my last name to my mothers last name it would be the same as my cousins I live in California.
